Terms of Service

The service

RankByReviews provides review invitation, review management and performance reporting tools for businesses. Features include SMS and email review invitations, a hosted review page, review monitoring and reply tools, suggested AI-drafted replies, and analytics dashboards. We may add, change or improve features over time.

Your account

You must provide accurate information and keep your login details secure. You are responsible for activity under your account. You must be authorised to act for the business you register.

Acceptable use and messaging rules

You may only send invitations to people who are genuinely your customers and who have consented to be contacted, as required by the Spam Act 2003 (Cth). Purchased or scraped contact lists are not permitted. Opt-out requests (such as STOP replies) are honoured automatically and must not be circumvented.

Review invitations must be neutral. Offering incentives for reviews, asking only happy customers, blocking the public review option, or posting fake reviews is prohibited. These practices breach Google's review policies and may breach the Australian Consumer Law. Our review flow always presents the public review option to every customer.

You must not use the service to send marketing unrelated to reviews, or any unlawful, misleading or harassing content.

Plans, credit and billing

Paid plans include a monthly message allowance; additional sending draws on prepaid credit purchased as top-ups. Message costs are shown in your dashboard before you buy.

There are no lock-in contracts. You can cancel at any time and your plan will not renew. Prepaid credit is not refundable except where the Australian Consumer Law requires otherwise.

Prices are in Australian dollars and may change with notice; changes never apply retroactively to credit you have already purchased.

Connected services

If you connect Google, payment or job management accounts, you authorise us to access those services on your behalf for the features you enable. You can disconnect at any time in settings. Our use of Google data is described in the Privacy Policy.

Content and intellectual property

You retain all rights in your business content, contact lists, reviews and videos collected through the service, and you can export them at any time. We retain all rights in the service itself. AI-drafted replies are suggestions; you are responsible for what you approve and post.

Service availability and liability

We aim for high availability but the service is provided without guarantees of uninterrupted operation, and depends on third parties such as Google, Twilio and Stripe.

Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss.

Termination

You may close your account at any time. We may suspend or terminate accounts that breach these terms, especially the messaging and review compliance rules, or where required by law. On closure we delete your data as described in the Privacy Policy.

General

These terms are governed by the laws of New South Wales, Australia. If we update these terms we will post the new version here with a new effective date; continued use after changes means you accept them. Questions: [email protected].
